1. GRANTED PATENT DETAILS

Congratulations — we're happy to confirm the patent has been granted.

This guide will outline things to consider and next steps to maintaining the granted patent rights.

2. THE PATENT TERM

The term of the patent is 20 years from the date of the patent, provided the annual renewal fees are paid.

Now the patent has been granted, any patented product, or associated promotional material or packaging, can be marked with the patent number. While it is not compulsory to mark ir display products in Australia with the patent number, it can help to make people aware of the existence of the patent and associated rights, and deter potential infringers.

3. RENEWALS

To maintain the patent and keep the granted rights in force, annual renewal fees must be paid.

These annual renewal fees are due from the fourth anniversary of the patent.

The renewal fees are payable 12-months before any due date, and up to 6-months after the due date — additional monthly late fees will apply.

If renewal fees are not paid, the patent will lapse.

4. Additional considerations

The Australian Patents Act requires any particulars relating to a patent, such as assignments, licences or mortgages, must be registered.

Also, please note the Australian Patent Office only issues electronic copies of Certificates of Grant. If a physical or certified document is required, please contact us.

Details of the patent are published and available on public databases.

You may receive scam letters from various companies about the patent.

If you receive any letters seeking any payment — please ignore them.

As the address for service for the patent matter, any official correspondence about the patent will be addressed from our office.
